SMS Consent Terms
These SMS Consent Terms explain SMS consent, opt-in requirements, message frequency, message and data rates, HELP, STOP, opt-outs, and privacy rules for text messages sent through TidyConvert.
These SMS Consent Terms apply to text messages sent, received, routed, or automated through TidyConvert. They explain how SMS consent, opt-ins, opt-outs, HELP requests, STOP requests, mobile number privacy, and messaging responsibilities work when TidyConvert or a business using TidyConvert communicates with customers, callers, or other end users.
TidyConvert provides messaging automation tools for missed-call responses, customer support, appointment assistance, pricing inquiries, service requests, demo follow-ups, account assistance, and related conversational communication. The business using TidyConvert is responsible for obtaining proper consent, configuring compliant messages, honoring opt-outs, and complying with applicable calling, texting, privacy, consumer protection, carrier, 10DLC, toll-free verification, and industry rules.
1. SMS Program Description
TidyConvert SMS may be used to send conversational text messages related to missed-call recovery, demo requests, customer support, appointment requests, service inquiries, pricing questions, after-hours responses, account assistance, staff routing, and follow-up communication related to a user’s request.
Messages may be sent by TidyConvert directly for demo, support, and account purposes, or by businesses that use TidyConvert to communicate with their own customers. Message content, message timing, workflow logic, business identity, and follow-up behavior may vary depending on the business account and how that business configures TidyConvert.
Messages sent through TidyConvert must be tied to a valid opt-in, customer request, support interaction, account relationship, or business communication purpose covered by the user’s consent.
TidyConvert does not permit unsolicited SMS, purchased contact lists, third-party lead lists, spam, deceptive messaging, or unauthorized bulk messaging.
All messages sent through TidyConvert must clearly identify the business responsible for the message where appropriate.
2. End-User Consent
End users must provide consent before receiving SMS messages from TidyConvert or from a business using TidyConvert. Consent must be collected through a clear opt-in process that explains the type of messages the user agrees to receive.
For TidyConvert demo requests, consent is collected through a web form with an unchecked SMS consent checkbox. The demo toll-free number is used for demo-related conversational messages, demo follow-ups, support, and account assistance only.
For businesses using TidyConvert to message their own customers, consent may be obtained through clearly disclosed opt-in methods such as:
- website forms with an unchecked SMS consent checkbox
- appointment booking forms or service request forms
- account registration, quote request, or intake forms
- texting an opt-in keyword such as START, JOIN, or SUBSCRIBE when supported
- documented verbal consent provided directly to the business when legally permitted
- other documented consent methods that clearly disclose SMS messaging terms
Providing a phone number alone does not automatically constitute consent. The opt-in method must clearly disclose that the user is agreeing to receive SMS messages.
At the time of opt-in, users should be informed that message frequency may vary, message and data rates may apply, they can reply STOP to opt out, and they can reply HELP for help.
3. Demo SMS Consent
When a user requests a TidyConvert demo and checks the SMS consent box, the user agrees to receive conversational SMS messages from TidyConvert related to the demo request, follow-ups, support, account assistance, and service questions.
TidyConvert demo SMS messages are not used for purchased lists, third-party lead lists, unrelated advertising, or unsolicited bulk messaging. Demo messages are sent only after the user submits a demo form or otherwise requests help from TidyConvert.

4. Customer Responsibility for Consent
TidyConvert customers are responsible for collecting, documenting, and maintaining all legally required consent before sending or triggering SMS messages through the platform.
Customers using TidyConvert agree that they will:
- obtain legally required consent before messaging end users
- send messages only for purposes covered by that consent
- identify their business clearly in messages where appropriate
- avoid misleading, deceptive, or unauthorized messaging
- honor opt-outs and suppression rules
- not require SMS consent as a condition of unrelated purchases or services
- comply with TCPA, carrier, toll-free, 10DLC, privacy, and consumer protection rules
- maintain accurate records showing how and when SMS consent was collected
5. Message Frequency
Message frequency varies based on the business, workflow, customer interaction, and type of communication. A missed-call recovery workflow may include an initial text-back and limited follow-up messages.
End users may receive messages when they submit a form, request a demo, contact a business, request information, book an appointment, ask a question, request pricing, need support, or otherwise interact with TidyConvert or a business using TidyConvert.
TidyConvert may apply internal message limits, rate limits, or fair-use controls to reduce abuse, protect deliverability, preserve platform performance, and manage telecom costs.
6. Message and Data Rates
Message and data rates may apply. End users should check their mobile plan for details. TidyConvert is not responsible for charges imposed by an end user’s mobile carrier.
7. Mobile Number Privacy and Data Sharing
TidyConvert does not sell, rent, or share mobile phone numbers or SMS consent data with third parties for their own marketing or promotional purposes.
Mobile phone numbers and SMS consent records are used to provide messaging services, support opt-out compliance, maintain suppression records, troubleshoot delivery issues, prevent abuse, and comply with legal, carrier, telecom, and platform requirements.
8. Opt-Out Instructions
End users may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or another supported opt-out keyword.
After an opt-out request is processed, the end user will no longer receive SMS messages from that sender through TidyConvert unless the end user later provides valid renewed consent.
9. HELP Instructions
End users may reply HELP at any time to receive assistance. HELP responses may include the business name, support contact information, opt-out instructions, and links to applicable terms or privacy information.
10. Opt-Out Suppression
TidyConvert may maintain suppression records, blocked contact records, opt-out history, or similar compliance data to help prevent additional messages to end users who have opted out.
Customers may not bypass, delete, override, or work around opt-out records, blocked contact rules, STOP requests, carrier blocks, or suppression controls in order to continue messaging an end user.
11. Re-Opt-In
If an end user opts out, SMS communications may only resume when legally permitted and after the end user provides valid renewed consent. The method of re-opt-in must satisfy applicable law, carrier requirements, and TidyConvert policy.
12. Prohibited SMS Content
Customers may not use TidyConvert SMS to send, promote, or facilitate:
- spam or unsolicited messages
- fraud, scams, phishing, or deceptive activity
- harassment, threats, intimidation, or abusive content
- misleading sender identity or impersonation
- malware, malicious links, or credential theft
- illegal products, services, or activity
- third-party lead generation or affiliate list messaging
- loan, debt relief, credit repair, or high-risk financial promotions without required approval
- cannabis, CBD, tobacco, vape, firearms, gambling, adult, or other prohibited content
- content prohibited by carriers, telecom providers, payment processors, or law
13. Restricted SMS Use Cases
Certain SMS use cases may require additional review, registration, documentation, or approval before messages can be sent. TidyConvert may restrict or reject messaging involving high-risk, regulated, or carrier-sensitive categories.
Examples may include healthcare, financial services, debt collection, legal services, government-related communications, political messaging, age-restricted products, regulated products, high-volume marketing, or other use cases subject to special rules.
14. Toll-Free, 10DLC, and Carrier Registration
Some business messaging may require toll-free verification, brand registration, campaign registration, carrier approval, or other telecom compliance steps. Customers are responsible for providing accurate business, campaign, consent, and message information when required.
TidyConvert may suspend, delay, limit, or reject messaging if registration information is incomplete, inaccurate, rejected, unverifiable, or unavailable.
15. Delivery Is Not Guaranteed
SMS delivery is not guaranteed. Messages may be delayed, filtered, blocked, rejected, or undelivered due to carrier rules, provider systems, recipient settings, device issues, incorrect numbers, registration status, message content, traffic patterns, or other factors outside TidyConvert’s control.
16. Monitoring and Enforcement
TidyConvert may monitor message activity, delivery results, opt-out rates, complaint rates, carrier feedback, error rates, suspicious patterns, or other indicators to detect abuse, spam, fraud, non-compliance, or platform misuse.
TidyConvert may block messages, disable workflows, suspend numbers, restrict accounts, require additional documentation, or terminate service if messaging creates legal, carrier, provider, security, operational, or reputational risk.
17. Customer Message Content
Customers are responsible for the content they create, approve, upload, configure, or send through TidyConvert. Customers must ensure their message templates, keywords, follow-ups, staff notifications, and automation rules are accurate, lawful, non-misleading, and appropriate for their business.
18. No Legal Advice
TidyConvert does not provide legal advice. These SMS Consent Terms are for platform policy and general informational purposes only. Customers should consult qualified legal counsel regarding their specific messaging programs, consent practices, compliance obligations, and industry requirements.
19. Relationship to Other Terms
These SMS Consent Terms supplement the TidyConvert Terms of Service, Privacy Policy, and Acceptable Use Policy. If there is a conflict between these SMS Consent Terms and another TidyConvert policy, TidyConvert may interpret and apply the policies in the manner that best protects legal, telecom, carrier, privacy, security, and platform compliance.
20. Changes to These SMS Consent Terms
We may update these SMS Consent Terms from time to time. When we do, we may revise the effective date above. Continued use of TidyConvert SMS after changes become effective means the updated terms will apply.
